At PropertyData.ae, we always aim to be clear and transparent about everything we do. That's why we publish our terms on our website for anyone to see.

1.1 These terms are the legal agreement between you and PropertyData, and you agree to them by using the PropertyData service.

1.2.1 Copyright in PropertyData's websites, apps, and its properties rests with PropertyData unless otherwise stated.

3.1 This terms of use (together with any documents referred to in it) tells you the terms of use on which you may make use of our website as a registered subscriber. Use of our website means registering to use our website; or accessing information through a web browser at our website; or downloading data via any means including API or raw data files.



3.2 Please read these terms of use carefully before you start to use our website, as these will apply to your use of our website. By using our website, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms of use, you must not use our website.



3.3. Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us, also applies to your use of our website. By using our website, you consent to such processing and you warrant that all data provided by you is accurate.



3.4 We may update our website from time to time, and may change the functionality or content at any time. The data provided through the website is derived from multiple third-party sources and we give no warranties that the data is up to date nor are we under any obligation to update it. We do not guarantee that our website, or any content on it, will be free from errors or omissions.



3.5 Our website is made available on a subscription basis. While we will endeavour to maintain a high degree of availability, we do not guarantee that our website, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw, discontinue or change all or any part of our website without notice. We will not be liable to you if for any reason our website is unavailable at any time or for any period.



3.5.1 You are responsible for making all arrangements necessary for you to have access to our website. You are also responsible for ensuring that all persons who access our website through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.



3.5.2 Accessing our website using any kind of automated script, scraper or robot is strictly forbidden, other than via our API in the ways authorised by these terms.



3.6 You must treat your login details as confidential. You must not disclose them to any third party. We have the right to disable any account at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. If you know or suspect that anyone other than you knows your login details, you must promptly notify us.



3.7 Users agree to be bound by our fair usage policy which ensures fair access to the PropertyData platform for all users.



3.8 PropertyData accounts are designed to be used only by a single individual. Account sharing is strictly prohibited.



3.9 Where our website contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources. We assume no responsibility for the content of websites linked on our website. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.



Section 4: Free Trial


4.1 If you choose to sign up to our free trial on our website, you must:

  • Choose between a monthly or annual subscription period.

  • Enter credit/debit card details. These will be held securely by our payment partner, Stripe.


4.2 We will send you an email in advance to let you know when the free trial period will end.


4.2.2 If, at the expiry of your free trial period, you have not cancelled your account, a paid subscription will automatically start and we will charge your stored card for your first billing period

4.3 Free trials are limited to one per person/entity. You may not set up multiple free trials (either concurrently or sequentially) using multiple email addresses. We reserve the right to permanently ban any user or entity who attempts to open multiple free trial accounts.



Section 5: Payments and Subscription Renewal



5.1 Your subscription will renew automatically at the end of each billing period, in the absence of action by you. We will charge your stored card and a successful payment will extend your subscription by one billing period.



5.2 We will not send users on a monthly subscription a reminder before each monthly renewal. We will send users on an annual subscription an email reminder a few days before their subscription renews.



5.3 If our attempt to charge your card under these terms & conditions is declined by your bank, your account will be suspended and we will notify you by email. We will try up to four further times over the following days to charge your card, before ceasing to attempt charges.



5.4 When we raise prices for new subscribers, we will usually allow existing subscribers to keep the price that they signed up at (known as 'grandfathering'). An unbroken subscription must be maintained to keep this 'grandfather rate' active on your account. We consider a subscription broken if it lapses for 7 days or more. Grandfathering is strictly at our discretion and not guaranteed to be offered to new subscribers in the future, or continued for subscribers who are currently enjoying it.




Section 6: Termination


6.1 All PropertyData subscriptions are 'rolling' with a minimum contract period of just one billing period (either month or year), which is renewed upon each successful charge.



6.2 You can cancel your subscription at any time in your account area, or by notifying us at support@propertydata.ae. If you cancel, you will be able to use your account until the end of the current paid-for billing period. No refund will be due for the remaining unused time.




Section 7: Refunds



7.1 If you disagree with a charge we have made to your stored credit/debit card, please contact us as soon as possible on support@propertydata.ae.



7.2 Once you have accessed the PropertyData software by way of logging in for the first time, you agree to waive rights to a refund of your subscription charge, except in exceptional circumstances as determined at our sole discretion.



7.2.1 You are, however, entitled to terminate your subscription as any time as per clause 6




Section 8: Permitted Use of Data



8.1 You may use data retrieved from our website or API in any legal way in commercial or non-commercial applications, subject the following restriction:



8.2 You may not publish, commercially exploit, sell, license or distribute data retrieved from our website or API as a product or service which comprises substantially of data retrieved from our website or API, without enhancement or added value.



8.3 We reserve the right to determine whether your use of data from our website or API is in compliance with these terms.



8.4 If you are a paying subscriber of PropertyData and in compliance with these terms, attribution of PropertyData.ae as the data source is required.



Section 9: Linking to Our Website



9.1 You may link to our website provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. 



9.1.1 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. 



9.2 Our website must not be framed on any other website. 



9.3 We reserve the right to withdraw linking permission without notice. 



9.4 If you wish to make any use of content on our website other than that set out above, please contact us at support@propertydata.ae.

10.1 The content, data and all other material published on our website are variously the intellectual property of us and/or our data suppliers, and are protected by copyright laws and treaties around the world. All such rights are reserved.



10.2 Notwithstanding clause 10.1, if you are a paying subscriber of PropertyData you may use screenshots, extracts or PDF downloads from our website or data from the API (in accordance with section 8 "Permitted use of data") for suitable commercial and non-commercial purposes.



10.2.1 In the case of screenshots, extracts or PDF downloads these must not be modified and you must acknowledge the source of the data.



Section 11: No Reliance On Information



11.1 The content on our website is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our website.



11.2 Although we make reasonable efforts to update the information on our website, we make no representations, warranties or guarantees, whether express or implied, that the content on our website is accurate, complete or up-to-date.



Section 12: Limitation of liability



12.1 Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. 13.5 By breaching any of these provisions, you would commit a criminal offence under the Computer Misuse Act 1990. 



13.5.1 We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them.

14.1 When you use PropertyData, you must provide us with personal information. We make a commitment that we  will only use your personal information in accordance with our Privacy Policy, which you can review at https://propertydata.ae/privacy.



14.2 The PropertyData Privacy Policy will give you a deeper understanding of how we will use your personal information, including  who we share it with, your rights around your personal data, how we protect it, and the legal basis for using it.



14.3 Your data may be used on any of our websites and apps including marketing pages.



14.4 No data transmission over the Internet can be guaranteed as totally secure. Whilst we strive to protect such information we do not warrant and cannot ensure the security of information which you transmit to us. Accordingly, any information which you transmit to us is transmitted at your own risk.



Section 15: Indemnification



15.1 You agree to indemnify PropertyData (its employees and agents) for any loss suffered or liability incurred by PropertyData (its employees and agents) arising from any unlawful, unauthorised or improper access or use of the Website or any breach of these terms by you or your employees, contractors or representatives.



Section 16: Changing This Agreement



16.1 We may make reasonable changes to this agreement at any time.



16.2 If we make changes, we will provide notice to you by publishing the most current version and revising the date at the top of this page.



16.3 We usually only make changes to the agreement when the changes:



(i) Help to improve or maintain the PropertyData service;



(ii) Are a result of changes or anticipated changes in the legal/regulatory requirements that apply to PropertyData;



(iii) Make this agreement easier to understand or more fair for you as a PropertyData customer;



(iv) Are a result of changes to our business operations resulting from changes or anticipated changes in the economic or technological environment;



(v) Are reflective of costs we incur, or;



(vi) Rectify an error.



16.4 Given the nature of this agreement, we may need to make changes to the agreement for reasons not set out above.



Section 17: Inaction



17.1 From time-to-time, at our discretion we may waive our rights under this agreement. This does not mean we will waive that same right - or any other right - in the future, and we may take action against you if we choose in a particular situation to not waive our rights in future. 



Section 18: Regulation and Legislation



18.1 This agreement is governed and interpreted under the law of England and Wales, and any disputes or claims you may have with us would be settled by courts of England and Wales, regardless of where PropertyData operates or you use PropertyData from.



18.2 Each section of this agreement operates separately – if any court or competent authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.



18.3 We may transfer our rights and obligations under these Terms to another organisation, and we will always notify you in writing if this happens. This will not affect your rights. You may not transfer your rights or obligations under these terms to another person or third party.

3.6 You must treat your login details as confidential. You must not disclose them to any third party. We have the right to disable any account at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. If you know or suspect that anyone other than you knows your login details, you must promptly notify us.



3.7 Users agree to be bound by our fair usage policy which ensures fair access to the PropertyData platform for all users.



3.8 PropertyData accounts are designed to be used only by a single individual. Account sharing is strictly prohibited.



3.9 Where our website contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those websites or resources. We assume no responsibility for the content of websites linked on our website. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.



Section 4: Free Trial


4.1 If you choose to sign up to our free trial on our website, you must:

  • Choose between a monthly or annual subscription period.

  • Enter credit/debit card details. These will be held securely by our payment partner, Stripe.


4.2 We will send you an email in advance to let you know when the free trial period will end.


4.2.2 If, at the expiry of your free trial period, you have not cancelled your account, a paid subscription will automatically start and we will charge your stored card for your first billing period

4.3 Free trials are limited to one per person/entity. You may not set up multiple free trials (either concurrently or sequentially) using multiple email addresses. We reserve the right to permanently ban any user or entity who attempts to open multiple free trial accounts.



Section 5: Payments and Subscription Renewal



5.1 Your subscription will renew automatically at the end of each billing period, in the absence of action by you. We will charge your stored card and a successful payment will extend your subscription by one billing period.



5.2 We will not send users on a monthly subscription a reminder before each monthly renewal. We will send users on an annual subscription an email reminder a few days before their subscription renews.



5.3 If our attempt to charge your card under these terms & conditions is declined by your bank, your account will be suspended and we will notify you by email. We will try up to four further times over the following days to charge your card, before ceasing to attempt charges.



5.4 When we raise prices for new subscribers, we will usually allow existing subscribers to keep the price that they signed up at (known as 'grandfathering'). An unbroken subscription must be maintained to keep this 'grandfather rate' active on your account. We consider a subscription broken if it lapses for 7 days or more. Grandfathering is strictly at our discretion and not guaranteed to be offered to new subscribers in the future, or continued for subscribers who are currently enjoying it.




Section 6: Termination


6.1 All PropertyData subscriptions are 'rolling' with a minimum contract period of just one billing period (either month or year), which is renewed upon each successful charge.



6.2 You can cancel your subscription at any time in your account area, or by notifying us at support@propertydata.ae. If you cancel, you will be able to use your account until the end of the current paid-for billing period. No refund will be due for the remaining unused time.




Section 7: Refunds



7.1 If you disagree with a charge we have made to your stored credit/debit card, please contact us as soon as possible on support@propertydata.ae.



7.2 Once you have accessed the PropertyData software by way of logging in for the first time, you agree to waive rights to a refund of your subscription charge, except in exceptional circumstances as determined at our sole discretion.



7.2.1 You are, however, entitled to terminate your subscription as any time as per clause 6




Section 8: Permitted Use of Data



8.1 You may use data retrieved from our website or API in any legal way in commercial or non-commercial applications, subject the following restriction:



8.2 You may not publish, commercially exploit, sell, license or distribute data retrieved from our website or API as a product or service which comprises substantially of data retrieved from our website or API, without enhancement or added value.



8.3 We reserve the right to determine whether your use of data from our website or API is in compliance with these terms.



8.4 If you are a paying subscriber of PropertyData and in compliance with these terms, attribution of PropertyData.ae as the data source is required.



Section 9: Linking to Our Website



9.1 You may link to our website provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. 



9.1.1 You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. 



9.2 Our website must not be framed on any other website. 



9.3 We reserve the right to withdraw linking permission without notice. 



9.4 If you wish to make any use of content on our website other than that set out above, please contact us at support@propertydata.ae.




Section 10: Intellectual Property Rights



10.1 The content, data and all other material published on our website are variously the intellectual property of us and/or our data suppliers, and are protected by copyright laws and treaties around the world. All such rights are reserved.



10.2 Notwithstanding clause 10.1, if you are a paying subscriber of PropertyData you may use screenshots, extracts or PDF downloads from our website or data from the API (in accordance with section 8 "Permitted use of data") for suitable commercial and non-commercial purposes.



10.2.1 In the case of screenshots, extracts or PDF downloads these must not be modified and you must acknowledge the source of the data.



Section 11: No Reliance On Information



11.1 The content on our website is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our website.



11.2 Although we make reasonable efforts to update the information on our website, we make no representations, warranties or guarantees, whether express or implied, that the content on our website is accurate, complete or up-to-date.



Section 12: Limitation of liability



12.1 Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our website or any content on it, whether express or implied.



12.2 We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:



  • use of, or inability to use, our website or API; or

  • use of or reliance on any content displayed on our website or API.



12.3 We will not be liable for:



  • loss of profits, sales, business, asset value or revenue;

  • business interruption;

  • loss of anticipated savings;

  • loss of business opportunity, goodwill or reputation; or

  • any indirect or consequential loss or damage.

  • any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any content on it, or on any website linked to it.



Section 13: Security and Malicious Actions



13.1 We do not guarantee that our website will be free from bugs or viruses. You are responsible for configuring your hardware and software in order to access our website. You should use your own virus protection software.



13.2 You must not misuse our website or API by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. 



13.3 You must not attempt to gain unauthorised access to our website, the server on which our website is stored or any server, computer or database connected to our website. 



13.4 You must not attack our website via a denial-of-service attack or a distributed denial-of service attack.



13.5 By breaching any of these provisions, you would commit a criminal offence under the Computer Misuse Act 1990. 



13.5.1 We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. 



13.5.2 In the event of such a breach, your right to use our website will cease immediately.



Section 14: Data Protection and Account Security



14.1 When you use PropertyData, you must provide us with personal information. We make a commitment that we  will only use your personal information in accordance with our Privacy Policy, which you can review at https://propertydata.ae/privacy.



14.2 The PropertyData Privacy Policy will give you a deeper understanding of how we will use your personal information, including  who we share it with, your rights around your personal data, how we protect it, and the legal basis for using it.



14.3 Your data may be used on any of our websites and apps including marketing pages.



14.4 No data transmission over the Internet can be guaranteed as totally secure. Whilst we strive to protect such information we do not warrant and cannot ensure the security of information which you transmit to us. Accordingly, any information which you transmit to us is transmitted at your own risk.



Section 15: Indemnification



15.1 You agree to indemnify PropertyData (its employees and agents) for any loss suffered or liability incurred by PropertyData (its employees and agents) arising from any unlawful, unauthorised or improper access or use of the Website or any breach of these terms by you or your employees, contractors or representatives.



Section 16: Changing This Agreement



16.1 We may make reasonable changes to this agreement at any time.



16.2 If we make changes, we will provide notice to you by publishing the most current version and revising the date at the top of this page.



16.3 We usually only make changes to the agreement when the changes:



(i) Help to improve or maintain the PropertyData service;



(ii) Are a result of changes or anticipated changes in the legal/regulatory requirements that apply to PropertyData;



(iii) Make this agreement easier to understand or more fair for you as a PropertyData customer;



(iv) Are a result of changes to our business operations resulting from changes or anticipated changes in the economic or technological environment;



(v) Are reflective of costs we incur, or;



(vi) Rectify an error.



16.4 Given the nature of this agreement, we may need to make changes to the agreement for reasons not set out above.



Section 17: Inaction



17.1 From time-to-time, at our discretion we may waive our rights under this agreement. This does not mean we will waive that same right - or any other right - in the future, and we may take action against you if we choose in a particular situation to not waive our rights in future. 



Section 18: Regulation and Legislation



18.1 This agreement is governed and interpreted under the law of England and Wales, and any disputes or claims you may have with us would be settled by courts of England and Wales, regardless of where PropertyData operates or you use PropertyData from.



18.2 Each section of this agreement operates separately – if any court or competent authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.



18.3 We may transfer our rights and obligations under these Terms to another organisation, and we will always notify you in writing if this happens. This will not affect your rights. You may not transfer your rights or obligations under these terms to another person or third party.
